Manta Splash LLC Liability Release, Assumption of Risks, and Policies

I. Waiver Agreement, Liability Release, and Risk Acknowledgment

By enrolling in swimming lessons with Manta Splash, I, _____________________, or as the legal parent/guardian of ________________________________________________, acknowledge and agree to the following:

Waiver Agreement:
Swimming is a physical activity that carries inherent risks, including but not limited to injury or death. Participation is voluntary, and I accept these risks on behalf of myself and/or my child.

Liability Release:
In consideration of the services provided by Manta Splash, I hereby release, discharge, and hold harmless Manta Splash and its agents from any and all claims, demands, actions, or causes of action for injuries or damages to my person, my child, or property arising out of or related to participation in swimming lessons.

Risk Acknowledgment:
I understand that swimming involves strenuous physical activity, and it is my responsibility to ensure that I and/or my child are physically fit to participate. Any pre-existing medical conditions must be disclosed before lessons begin.

II. Policies

Pool Conditions & Regulation Responsibility:
Clients must ensure the pool used for lessons meets appropriate safety standards, including proper pH levels, chlorine levels, and temperature. Please refer to the CDC's Residential Pool Disinfection and Testing guidelines. Failure to maintain these conditions may result in fees or lesson cancellations.

Cancellation & Makeup Policy:
To maintain a consistent and efficient schedule for all families, we enforce the following cancellation limits:

  • Monthly Cancellation Limits:

    • 1 lesson/week: Up to 1 cancellation/month

    • 2 lessons/week: Up to 2 cancellations/month

    • 3+ lessons/week: Up to 3 cancellations/month

  • Proper Notice:
    Cancellations must be made at least 24 hours in advance. If proper notice is not given:

    • For packages: The lesson will be marked as completed.

    • For single lessons: A fee equal to the full cost of the lesson will be charged. No refunds will be provided.

  • Makeups:
    Clients have 10 days to reschedule and complete a makeup lesson after a proper cancellation. After 10 days, the lesson may be considered complete, and a fee equal to the full lesson cost will apply.

  • Extended Trips:
    Lessons missed due to pre-notified trips must be rescheduled and completed within 2 weeks of return. After this period, standard cancellation policy applies.

  • Late Shows:
    Any delay will be deducted from the lesson time. After a 10-minute grace period, the lesson may be forfeited without refund or makeup.

  • Weather-Related Rescheduling:
    Lessons may be canceled or rescheduled due to inclement weather or unforeseen circumstances free of charge and in the event of extended inclement weather, the makeup period may be adjusted at the instructor’s discretion.

III. Photo and Video Release

I grant Manta Splash permission to use photos and videos taken during lessons for promotional and marketing purposes. Clients may opt out of this release by providing written notice.

IV. Emergency Medical Consent

In the event of an emergency, I authorize Manta Splash LLC to administer basic first aid or CPR. If further medical attention is required, I consent to contacting emergency services and accept responsibility for any associated costs.

V. COVID-19 Assumption of Risk

I acknowledge the contagious nature of COVID-19 and voluntarily assume all risks associated with exposure to or infection by COVID-19 during participation in swimming lessons.

VI. Electronic Signature Agreement

By signing this document, I acknowledge that I have read and fully understand its contents. I agree to all terms and policies outlined above.
