Liability Release, assumption of risks, and policies
I. Waiver Agreement, Liability Release, and Risk Acknowledgment:
I, [Releasee's Full Name], or as the legal parent/guardian/family member, hereby acknowledge and agree to the following terms and conditions for participating in swimming lessons with Manta Splash:
Waiver Agreement: I understand that swimming is a physical activity that involves inherent risks, including the risk of injury or death. I voluntarily choose to participate in swimming lessons with Manta Splash with full knowledge of these risks.
Liability Release: In consideration of the services provided by Manta Splash,, its instructors, and agents, I hereby release, discharge, and hold harmless Manta Splash and its representatives from any and all claims, demands, actions, or causes of action for injuries sustained to my/our person and/or property arising out of or connected with participation in swimming lessons.
Risk Acknowledgment: I acknowledge that swimming activities may involve strenuous physical activity, and I am responsible for ensuring that I am in good health and capable of participating in such activities.
II. Policies:
Pool Conditions:
Regulation Responsibility: It is the responsibility of the client/parent/guardian to ensure that the pool where the swimming lesson takes place maintains appropriate pH levels, chlorine levels, and temperature. We encourage following the guidelines provided by the Centers for Disease Control and Prevention (CDC) for residential pool disinfection and testing, available at CDC Residential Pool Disinfection and Testing.
Lesson Count: I acknowledge that swimming lessons will still be counted as attended if, upon arrival, the instructor deems the conditions to be unsafe for the lesson to proceed.
Client's Responsibility: It is my responsibility to regularly check and regulate the pool conditions to ensure they meet the necessary standards before each scheduled lesson.
Effect on Fees: Failure to maintain proper pool conditions may result in additional fees or cancellation of lessons, at the discretion of Manta Splash.
Photo and Video Release: I hereby grant Manta Splash permission to use photographs and/or videos taken during swimming lessons for promotional and marketing purposes, including but not limited to online and offline materials.
Cancellation Policy:
Lessons must be canceled at least 24 hours before the scheduled lesson to avoid a cancellation fee.
If cancellation is done 1-2 hours before class time and/or at arrival of class time, you will be charged fully for the lesson and no make ups are allowed.
Late Shows and Make-Ups:
A grace period of 10 minutes will be allowed for late arrivals, after which the lesson may be considered canceled, and no refund or makeups will be provided.
Make-up lessons may be provided at the discretion of Manta Splash for cancellations made within the specified timeframe.
Weather-Related Rescheduling:
Swimming lessons may be canceled or rescheduled due to inclement weather or other unforeseen circumstances.
III. Assumption of Risk and Liability for COVID-19:
I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 while participating in swimming lessons with Manta Splash. I agree to comply with all safety guidelines and protocols established by Manta Splash to prevent the spread of COVID-19.
I release, discharge, and hold harmless Manta Splash and its representatives from any and all claims, demands, actions, or causes of action for injuries or damages, including but not limited to illness or death, arising out of or connected with the exposure to or infection by COVID-19 during participation in swimming lessons.
